Click_Here_for_Article:The U.S. District Court has recently appointed lawyers Joseph A. Niskar and Michael C. Naughton to assist James C. Thomas with the defense of Kwame Kilpatrick’s current federal indictment involving the Civic Fund and Tax charges.
Joseph A. Niskar previously represented Mayor Kwame Kilpatrick during his State Court cases arising out of the “text message” scandal and also participated in the Governor’s Removal Hearings which ultimately led to the Mayor’s resignation.

On the heels Umar Farouk Abdulmutallab’s arrest, we are again reminded of the awesome charging powers of the government. I am sure the lessons learned by the United States Attorney’s Office from the case of United States v. Koubriti will ensure that this defendant will receive a fair trial.

Depending on the type of conviction, Michigan law prohibits a convicted felony from possessing a firearm until they have taken affirmative steps to have their rights restored.
The U.S. Sixth Circuit Court of Appeals has recently held that the Double Jeopardy Clause is not violated where a defendant is convicted of both Felon in Possession of a Firearm and Felony Firearm in Michigan. Because of the penalty associated with the Felony Firearm charge (mandatory two years in prison without good time credits), it is imperative to take affirmative steps to have your rights restored as soon as you become eligible.
