Detroit Terror Suspect

On the heels Umar Farouk Abdulmutallab’s arrest, we are again reminded of the awesome charging powers of the government. I am sure the lessons learned by the United States Attorney’s Office from the case of United States v. Koubriti will ensure that this defendant will receive a fair trial.
Right to Carry Firearms
The Law Office of Joseph A. Niskar represents clients who are attempting to have their rights to possess and carry a firearm after having been convicted of a felony. Depending on the type of conviction, Michigan law prohibits a convicted felony from possessing a firearm until they have taken affirmative steps to have their rights restored.
The U.S. Sixth Circuit Court of Appeals has recently held that the Double Jeopardy Clause is not violated where a defendant is convicted of both Felon in Possession of a Firearm and Felony Firearm in Michigan. Because of the penalty associated with the Felony Firearm charge (mandatory two years in prison without good time credits), it is imperative to take affirmative steps to have your rights restored as soon as you become eligible.
