Acquittal Secured for Assault Charge

On the night in question, our client was visiting friends at Michigan State University. He was assaulted by a fellow passenger. With the help of another passenger, our client removed the individual from the vehicle.
This person then told police that he was the victim. Prosecutors charged our client with assault based on the supposed victim’s statements. Our client was offered a plea deal that would seal his record and order him to complete a period of probation. However, our office did not feel this was a fair offer, so we opted to take this matter to trial.
During a jury trial, we were able to elicit testimony from the alleged victim that he had lied to police about the “assault.” We also managed to reveal there were holes in his memory, demonstrated during cross examination. We played a 911 call the victim had made which contradicted the statements he had testified about, and we managed to have him testify that his injuries may have occurred after he left the scene, not that they were the result of an assault.
The jury gave a brief deliberation, and returned a not guilty verdict, acquitting our client.
