Criminal Record Cleared Through Expungement

A veteran and non-commissioned officer in the armed forces hired the Davis Law Group, PLLC seeking assistance with a pardon. Our client was in the process of adopting children but faced a hurdle because of his criminal record. Initially deemed ineligible by the Attorney General for expungement because he had four felony convictions (the maximum allowed under Michigan law is three), he turned to us for help after another attorney could not resolve the issue.

We were the second firm he retained to correct his problem. Attorney Spencer Clayton led our team through this case.

After a thorough investigation, which required gathering police reports and records from multiple courts, we discovered that one of his felony convictions from 1998 was recorded in error.

Despite objections from both the Attorney General and the County Prosecutor, we presented compelling evidence, including detailed exhibits, and appeared before a Clinton Township District Court judge twice to argue our case.

We provided proof to the court that his fourth conviction was an error and that our client was eligible to have his record set aside. Finally, the judge granted our request, correcting the error and setting aside the incorrect conviction, making our client eligible to have his record expunged.

This result allowed our client to pursue his ultimate goal of adopting children.
